A 23-year-old New South Wales man has been refused bail after allegedly leading police on a high-speed pursuit – even though he claims he wasn’t driving.

At about 10:45pm on Thursday July 18, Mount Druitt Highway Patrol officers attempted to stop a Holden Insignia VXR on Christie Street in St Marys.

However, the driver failed to stop, with officers instigating a police pursuit which resulted in the Holden allegedly exceeding the speed limit by more than 45km/h.

Shortly after, the driver overshot the driveway of a 7-Eleven petrol station on Forrester Road, causing the Holden to mount the kerb and crash.

Officers noticed the driver moved from the driver’s seat to the left-rear seat, which he then used to claim, “it couldn’t be me driving.”

The 23-year-old was discovered to have an expired licence and returned a positive roadside breath test with a blood-alcohol concentration (BAC) of 0.119 – more than double the limit of 0.05.

After being arrested and taken to Mount Druitt Police station, the man was found to be in breach of his bail conditions. He then failed to provide a sufficient breath test for analysis.

The charges against him included police pursuit, driving unlicensed, refusing a breath analysis, exceeding the speed limit by more than 45km/h and breach of bail.
